Regional Sponsored Migration Scheme

The Regional Sponsored Migration Scheme (RSMS-187) enables an overseas employee to obtain a permanent visa to live in regional Australia.  This visa is designed to attract skilled workers to fill a skills shortage gap across regional areas. Visa applicants must be nominated by an Australian employer.

 

There are three stages to the application:

 

1. RCB Certification

 

In order to apply for RSMS 187 visa, a nomination (see below) must be certified by an approved Regional Certifying Body (RCB).  The role of RCB is to assess the nominated position against regional planning needs by way of reviewing labour market testing information and determining whether there is a need for a full time, foreign employee on a permanent basis.  RCB requirements vary from state to state.  There may be number of RCB’s per state therefore it is important to check local requirements prior to proceeding.  RCB certification process can take a number of weeks to finalise.

 

2. Company Nomination

 

A company nomination must be filed by an Australian employer.  Nomination is the process of identifying a position to be filled by foreign employee.  In order for the nomination to be approved, the business must demonstrate the following:

 

  • Position must be in a regional area

  • Skills and experience required for the position

  • Market salary rate for the position and the salary rate to be paid to the prospective overseas employee

  • Evidence of good financial standing

  • Need for a paid employee

 

3. Visa Application

 

In order to apply for a subclass 186 visa, an applicant must demonstrate:

 

  • They have met applicable age requirement unless exemptions apply

  • Relevant skills

  • Meet any health character or language requirements

  • Hold applicable registration and licensing

 

A visa applicant will need to make a commitment to reside in a regional area for a period of time.

 

There are three streams to apply for a RSMS Visa:

 

1. Temporary Residence Transition Stream

 

This stream is available to existing subclass 457 visa holders who have worked for their employer on a 457 visa in the nominated role for a prescribed period of time.  To qualify, an applicant must:

  • Be a primary subclass 457 visa holder

  • Hold registration, licensing or professional membership, if required for your occupation in the state or territory in which you will be working

 

2. Direct Entry Stream

 

This stream is available skilled worker from overseas.  To qualify, an applicant must:

  • Have appropriate skills to perform the role or undertake a formal skills assessment

  • Hold registration, licensing or professional membership, if required for your occupation in the state or territory in which you will be working

 

3. Agreement Stream

 

This stream is available skilled workers from overseas who are able to secure a permanent role with an Australian employer under  a Labour Agreement.  Terms and conditions of this stream as well as eligibility criteria is dictated by the specific labour agreement.
