Data Matching to Enhance Compliance in SC457/482 programs


On 9 Jan 2019 the Department of Home Affairs issued a notice regarding SC457/482 visas. In the notice the Department announced it will start exchange data with the Australian Taxation Office (the ATO) to identify whether work visa sponsors and holders have complied with their obligations and visa conditions.


What does this mean to me?


If you are a SC457/482 visa sponsor, the Department will provide to the ATO details of yourself and your business to enable the ATO to identify whether there is any incompliance between the remuneration you claimed you would pay to the visa holder and the actual salary you pay to your nominee.


If you were or are a SC457/482 visa holder since FY2015/2016, the Department will provide your biographical details, including name, address and date of birth to the ATO to ensure whether you only worked for your approved employer and work in the approved occupation.


Where non-compliance is identified, the Department may consider cancelling a sponsor’s sponsorship status and cancel the visa holder’s visa.


It is estimated that the number of individuals affected by the policy will be around 280,000.
