Labour Market Testing and the UK

Labour Market Testing and the UK

As of May 31, 2023, the Australia-United Kingdom Free Trade Agreement (A-UKFTA) has been implemented. As part of this agreement, the Department of Home Affairs announced an exemption to the labour market testing (LMT) requirement for Temporary Skill Shortage (TSS) nomination applications for citizens or permanent residents of the United Kingdom and this was published on their website.

However, it's important to note that the LMT exemption may have certain limitations and may apply only in specific circumstances. The Department of Home Affairs has not yet provided clear guidance on the exact circumstances under which this exemption applies.

Due to the potential complexity and uncertainties surrounding the LMT requirements for employer-sponsored applications, it is highly advisable to seek professional advice from one of our experienced Registered Migration Agents.

If you have any concerns or questions about the LMT exemption under the A-UKFTA or any other immigration matters, it is recommended to get in touch with one of our experts to receive tailored advice and navigate the visa application process with confidence.
